           Legislation to change regarding EPC for Buy To Let in Doncaster and across the UK
          &#xD;

           N 2022 the Government proposed new changes to the EPC regulations that would change the Minimum Energy Efficient Standards, coming into play between 2025 - 2028.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h2&gt;&#xD;
  &lt;h2&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/h2&gt;&#xD;
  &lt;h3&gt;&#xD;
    &lt;span&gt;&#xD;
      
           What is an EPC Rating?
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h3&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           First introduced in 2007, an EPC (Energy Performance Certificate) rating is used in England and Wales to judge a property's energy efficiency on a scale of A-G, with A being the most efficient and G the least.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           A low EPC rating can result in lower energy bills as well as reducing your carbon footprint, which makes the property more attractive to potential tenants and buyers.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Landlords are responsible for providing tenants with an EPC rating and have to get a new rating every 10 years.
          &#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h3&gt;&#xD;
    &lt;span&gt;&#xD;
      
           What are the new changes?
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h3&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           At the moment, you need an EPC rating of at least an E to be able to rent out your property. The big change is that beginning in 2025, any newly rented properties will need a rating of at least a C, and any existing tenancies will have until 2028 to do the same. The changes are being put in place to ensure energy-efficient homes meet the government net-zero carbon targets.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           To go alongside the change of rating, a harsher penalty up to  £30,000 per property will be dished out to a landlord for non-compliance
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h3&gt;&#xD;
    &lt;span&gt;&#xD;
      
           How to prepare
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h3&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           These changes could potentially cost landlords thousands of pounds, but the government have helped out with a list of things that will help to increase EPC rating. They recommend starting with low-cost measures such as adding insulation to wall cavities, floors, and lofts. They also suggest installing a smart meter and LED lights throughout the property.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           To get a rating of C, landlords may have to splash the cash by getting more expensive products such as triple-glazed windows, solar panels, and more energy-efficient boilers.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h3&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Will landlords get financial support?
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h3&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           At present, there is no plan for landlords in Doncaster or in any part of the UK to receive any financial support to help deal with the new changes, but landlord associations and regulatory bodies are coming together to call for support financially.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;

           We feel it is really important to note that these pricing bands do not renew with change of ownership so any potential buyers of distressed &amp;amp; or empty properties should be awere of this.
          &#xD;
    &lt;/span&gt;&#xD;

    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;

           Below is the information that details the changes and dates that the changes are imposed from, it notes the pricing band changes for empty properties across Doncaster - we feel this is very useful information for local landlords, letting agents &amp;amp; property owners as well as prospective buyers.

  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;

    &lt;span&gt;&#xD;
      
           From 01/04/2020
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           The premium is increasing in line with new legislation (The charge examples assume a standard Council Tax charge of £1,000.00).
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Properties empty for 2 to 5 years will be subject to a 100% premium. This means a 200% charge will be payable e.g. £2,000.00.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Properties empty for more than 5 years will be subject to a 200% premium. This means a 300% charge will be payable e.g. £3,000.00
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           From 01/04/21
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Properties empty for more than 10 years will be subject to a 300% premium. This means a 400% charge will be payable e.g. £4,000
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Please note:
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           The 2, 5 and 10 year periods start when the property first becomes empty and unoccupied and do not start again with a change of ownership.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Empty and substantially furnished properties are charged 100% from day one, but do not attract a premium.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;

           Doncaster was granted city status as part of Queen Elizabeth II's Platinum Jubilee celebrations in early 2022.

           Yes, i'm afraid, its more bad news for landlords across Doncaster.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           For those Doncaster landlords that don’t know, landlords will need to check the immigration status of any new tenants moving into properties from February 2016 or face a £3,000 fine. It a new piece of legislation called the ‘Right to Rent’ rules.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           In recent conversation a landlord from Kirk Sandall wanted to know how much of a real issue was ‘Right to Rent’ was to him and his portfolio of properties across Doncaster. I was able to tell him, the last available figures (from a couple of years ago) show that 174 people (whom were registered as Non-UK Born Short-term Residents) moved into private rented accommodation in the Doncaster Metropolitan Borough Council area in. If all of those people weren’t supposed to be in the UK, that would be a fine of £522,000 to the landlords of the town.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           It doesn’t sound a lot when you think there are 308,100 residents in Doncaster Metropolitan Borough Council area, and of those the vast majority were born in the UK. But Doncaster is a cosmopolitan city as the country of birth of the residents in the Doncaster Metropolitan Council area can be split down as follows:
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           However, it must also be recognised that landlords, by checking up on tenants, could potentially be accused of discrimination under the Equality Act. This is a real minefield for landlords, especially when you consider that not all of the Europeans in the area necessarily have the right to live in the UK either.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           In summary Doncaster landlords will need to check and retain copies of certain documents that show a potential tenant has the right to live in the UK.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;

    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Travel document or Permanent Residence Card showing indefinite leave to remain
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Paperwork from Home Office stating their Immigration status
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Certificate of registration or naturalisation as a British citizen.
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;

           This recent legislation is just another layer in the ever increasing pressure put on landlords in South Yorkshire and landlords across the UK in general.

           The future of Doncaster Sheffield Airport (DSA) has been thrown into doubt after bosses said the business "may no longer be commercially viable".
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           DSA's owner, the Peel Group, said a combination of the impact of the coronavirus pandemic and a shortfall in passenger numbers had been exacerbated by the announcement in June that operator Wizz Air was quitting the airport. Tui is now the sole carrier.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Chairman Robert Hough said: "It is a critical time for aviation globally. Despite pandemic related travel restrictions slowly drawing to a close, we are still facing ongoing obstacles and dynamic long-term threats to the future of the aviation industry. 
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           "The actions by Wizz to sacrifice its base at Doncaster to shore up its business opportunities at other bases in the South of England are a significant blow for the airport."
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Since the Peel Group acquired the site in 1999 and converted it into an international commercial airport, which opened in 2005, it said it had invested significant amounts of money.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           But it said, despite growth in passenger numbers, DSA had "never achieved the critical mass required to become profitable".
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Along with the pandemic and "increasingly important environmental considerations" the company said it had concluded that "aviation activity may no longer be the use for the site which delivers the maximum economic and environmental benefit to the region".
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           It would now carry out a review on how best to "maximise and capitalise on future economic growth opportunities". 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Mr Hough said: "Now is the right time to review how DSA can best create future growth opportunities for Doncaster and for South Yorkshire. 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           "The Peel Group remains committed to delivering economic growth, job opportunities and prosperity for Doncaster and the wider region."
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           The company said the airport would operate as normal while a review was carried out and passengers should plan for their journeys as normal.

           Make sure you are dealing with a genuine cash buyer who is in a position to complete on your property quickly, and not just an investment club or agent. Ask for proof of recent properties they have purchased from other customers along with contact details for the sellers so you can verify the deal went through without any hold-ups.

  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Watch out for companies that charge fees.
          &#xD;
    &lt;/span&gt;&#xD;

           We do not charge any fees, of any kind. There are companies in the industry, however, that aim to make money on fees. If a company is asking for any upfront costs, including survey or valuations fees, then be wary. If they are a genuine cash buyer of property they will not expect you to pay out any monies. Always check to see if there are fees involved before committing to anything.
          &#xD;

  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;

           Watch out for companies offering full market value.
          &#xD;

           Beware of any company claiming to offer up to 100% of ‘market value’ for your property. As with any business, a property buyer needs to factor in making a profit, and this simply would not be possible if they were paying full market prices for properties. Unless you are dealing with a charitable organisation, any company claiming to pay you ‘full market value’ should set alarm bells ringing.

           The landscape of the Uk's PRS is changing rapidly landlords and property owners across Doncaster need to be aware to the current legislation or risk getting caught short.

    &lt;span&gt;&#xD;
      
           The safety of your rental property is a significant aspect of letting with huge penalties for non-compliance. Intended as guidance only please see below:

  &lt;/p&gt;&#xD;
  &lt;h4&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Gas Safety
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h4&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           The Gas Safety (Installation and Use) Regulations 1998 outline your duties as a landlord to make sure all gas appliances, fittings, chimneys and flues are safe and working efficiently. If you’re letting a property with gas appliances installed, you’ve got three main legal responsibilities:
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h4&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Gas safety checks
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h4&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           To ensure your tenants’ safety, all gas appliances and flues need to undergo an annual gas safety check – and always by a Gas Safe registered engineer. Once this has been done, you’ll be given a Landlord Gas Safety Record or Gas Safety certificate with details of all the checks that were carried out. It can also be referred to as a CP12 certificate.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h4&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Gas Safety Record
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h4&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Following the annual gas safety check and receipt of your Landlord Gas Safety Record, you’ll need to provide a record of this check to your tenants. By law, a copy of your Landlord Gas Safety Record should be given to your current tenants within 28 days of the gas safety check – and for new tenants, you’ll need to provide this at the start of their tenancy.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h4&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Maintenance
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h4&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           You’ll need to make sure that all gas pipework, appliances, chimneys and flues are kept in safe condition.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Landlords and/or managing agents can be convicted for non-compliance. The standard penalty is a £6,000 fine for each item and/or 6 months imprisonment. In the most serious cases charges of manslaughter could be brought.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h4&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Electrical Safety
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h4&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           The Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020 advise that Landlords of privately rented accommodation must:
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;ul&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Ensure the electrical installations in their rented properties are inspected and tested by a qualified and competent person at least every 5 years.
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Obtain a report from the person conducting the inspection and test which gives the results and sets a date for the next inspection and test.
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Supply a copy of this report to the existing tenant within 28 days of the inspection and test.
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Supply a copy of this report to a new tenant before they occupy the premises.
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Supply a copy of this report to any prospective tenant within 28 days of receiving a request for the report.
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Supply the local authority with a copy of this report within 7 days of receiving a request for a copy.
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Where the report shows that remedial or further investigative work is necessary, complete this work within 28 days or any shorter period if specified as necessary in the report.
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Supply written confirmation of the completion of the remedial works from the electrician to the tenant and the local authority within 28 days of completion of the works.
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
  &lt;/ul&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;

           Energy Performance Certificate
          &#xD;
    &lt;/span&gt;&#xD;

  &lt;ul&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Since the 1st of October 2008 any landlord that markets an investment property for letting needs an Energy Performance Certificate known as an EPC. An EPC is broadly similar to the labels provided with domestic appliances such as fridges and washing machines. They provide a rating of how energy efficient a building is by giving it a rating between A &amp;amp; G, where A is very efficient. The idea being that tenants can use an EPC to make informed decisions on which property to rent based partly on their likely fuel efficiency.
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Since 1st April 2020 EPC’s must have a rating of E or above.
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
  &lt;/ul&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           A Star Property Group have an in house RdSap DEA assessor that can advise clients on EPC matters during sale or property management.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h1&gt;&#xD;
    &lt;span&gt;&#xD;
      
           When do landlords need an Energy Performance Certificate (EPC)?
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h1&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           The Energy Performance Certificate and recommendation report must be made available free of charge by the landlord to any prospective tenant at the earliest opportunity. The government defines these “opportunities” as being when: “any written information about the building is provided in response to a request for information received from the prospective tenant” or “when a viewing is conducted”
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           If neither of the above takes place then the EPC must be produced before the tenancy agreement is signed.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;

           The penalty for failing to make an EPC available to any prospective buyer or tenant is fixed in most cases, at 12.5 per cent of the rateable value of the building, with a default penalty of £750 where the formula cannot be applied

           According to the Health and Safety Executive (HSE) website landlords who provide residential accommodation or who are responsible for the water system in their premises have a duty to assess the risk from exposure to Legionella to their residents, guests, tenants and customers.

           What is Legionnaires’ disease?
          &#xD;
    &lt;/span&gt;&#xD;

  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Legionnaires’ disease is caused by legionella bacteria, is a potentially fatal form of pneumonia and everyone is susceptible to infection. The risk increases with age but some people are at higher risk including: people over 45 years of age, smokers and heavy drinkers, people suffering from chronic respiratory or kidney disease, diabetes, lung and heart disease, anyone with an impaired immune system.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h4&gt;&#xD;
    &lt;span&gt;&#xD;
      
           How do people get it?
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h4&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Legionella bacteria are widespread in natural water systems, e.g. rivers and ponds. However, the conditions are rarely right for people to catch the disease from these sources. Outbreaks of the illness occur from exposure to legionella growing in purpose-built systems where water is maintained at a temperature high enough to encourage growth, e.g. hot and cold water systems (work and domestic).
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h4&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Legionella risk assessment
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h4&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           HSE requires private landlords to carry out a risk assessment to identify and assess potential sources of exposure, and thereafter, where a risk has been identified to introduce a course of action to prevent or control any identified risk.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Most small systems only need a risk assessment and no further action is required however it is important to have the evidence available that the risk assessment has been carried out.
           &#xD;
      &lt;br/&gt;&#xD;
      
           The risk assessment can be carried out by the landlords themselves is they are competent to do so, or can be done by a qualified third party.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;

    &lt;span&gt;&#xD;

           Private sector landlords are required from 1 October 2015 to have at least one smoke alarm installed on every storey of their properties and a carbon monoxide alarm in any room containing a solid fuel burning appliance (eg a coal fire, wood burning stove). After that, the landlord must make sure the alarms are in working order at the start of each new tenancy.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           The requirements will be enforced by local authorities who can impose a fine of up to £5,000 where a landlord fails to comply with a remedial notice.

           Right to Rent Check
          &#xD;

           The ‘Right to Rent’ regulation was introduced on 1st of February 2016 to ensure that whoever is applying to rent your property has the right to reside and rent a property in the UK. Anyone without a right to reside is disqualified from renting.

           There are hefty fines of up to £3,000 and even the risk of imprisonment for any Landlord found to be housing a tenant that does NOT have the Right to Rent.

           Inventory
          &#xD;

           “The property is empty I don’t need an inventory” is something we hear frequently from our landlord clients.

    &lt;span&gt;&#xD;
      
           An inventory is a full schedule recording the condition of the property prior to the start of the property, including everything from the colour, quality &amp;amp; condition of the carpets, whether there are internal doors, working light bulbs, flushing toilets, if the cooker is clean etc.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           If there is no inventory signed &amp;amp; agreed by the tenants at the start of the tenancy, as landlord you will have no grounds to make any claim against or deductions from the Security Deposit at the end of the tenancy.
